一个月前看open house看中这个房子, 谈好了价格, 房检也没问题,让发合同,结果
昨天收到合同, 上面成了short sale, 再一查网站, zilliow上 05/27/2019 却显示房
子 scheduled to be sold at a foreclosure auction on 6/25/2019, 请问各位高手
,这是怎么回事?

很简单他们已经很久没付MORTGAGE了,short sale可能银行没有批准,
已经进入FORECLOSE阶段了,房子已经被银行收走只是还没轰他们走而已

卖家想拿我签的short sale 合同去说服lender同意这个short sale,我家律师建议要
求降价100K再签,不知是否会批准?如果不批,是否可以加价直到批准? 我蛮喜欢这个
房子,不想走到foreclosure那一步.

Your attorney is without foreclosure experience, in this case, he should
check all liens seized on this property, and conclude a competitive offer to
the bank, but unfortunately, your offer is far away from an expectation of
the bank, the bank must pay a big cost to foreclose a house and will harvest
more than your offer.
It is too late to resubmit your offer, the removal of the foreclosure
depends on how the mortgagor deals with the bank on default of the mortgage
loan. It should have to take 15 days to submit a request before the
foreclosing date.

Get the experience and walk away.

卖家律师传给我的short sale 合同我还没有签,房子的市场估价大概1.26M,Liens查
了是1.44M,我家律师建议要求降价100K再签合同,请问怎么知道银行的expectation?
难道要出比市场估价高的才是competitive offer吗?

A foreclosure attorney should check with the lien holders and can estimate
what the role does the bank play in the case, and what the start bidding
price could be set by the banker, if the case involves the junior liens
holders, it could be a great opportunity for the first lien holder (the bank
) to create a big margin, the start bidding price could be lower than the
market price, or could be just a default mortgage loan amount, the whole
process is a game and gambling. In your case, all cash must be paid if the
bidder wins, remember all cash.
I am not sure you can understand all, but your attorney must know it before
making an offer.

谢谢你的建议. 现在还没有走到foreclosure那一步,对方律师发给我们short sale的
合同,我的律师建议砍价,请问怎么知道银行/lender的expectation,难道要出比市场
估价高的才是competitive offer, short sale才会被批准吗?多謝

不要自找麻烦,这种多半一两年也卖不掉,我被SHORT SALE骗过两次了
以后再也不碰这种,你想人房贷都不还了,还会对你讲信誉?我就被人
赖了三个月的押金,你去告他,也要折腾半年。
